Aged Dependent Relative Visa (Subclass 114 and 838)
Old Dependent Relative Visas (subclasses 114 and 838).
Subclass 114 and subclass 838 aged relative care visas allow an Australian citizen, Australian permanent resident, or eligible relative of an elderly New Zealand citizen to remain in Australia permanently This visa is granted based on financial stability and specific age.
Subclass 114 is intended for relatives of age-based visa applicants outside Australia. Applicants must apply for and obtain a visa at an offshore location.
Subclass 838 Age-based relative visas are available for applicants already in Australia. Applicants must apply for and obtain a visa while on site.
Advantages of Holding an Aged Dependent Relative Visa
As a senior-dependent relative visa holder (subclasses 114 and 838), you are entitled to:
- Stay in Australia permanently
- Apply for Australian citizenship to establish your eligibility
- Travel in and out of Australia for five years from the date of visa
Qualification Criteria
For visa applicants
- You must be sponsored by a family member or their partner living in Australia
- You don’t have to be married or in a real relationship
- You must meet dependency and age criteria
- You need someone to reassure you
- You must meet all health and character standards
For Sponsors
- You must be 18 years of age or older
- You must be established in Australia as an Australian, Australian permanent resident, or eligible New Zealand citizen
- You must be a normal Australian resident
Sponsorship Responsibilities
If you support your immediate family and accompanying family members when you arrive in Australia on this visa, you can:
- Residential dwellings
- Financial assistance
If you are determined to guarantee support for your relatives and their families for two years:
- providing sufficient financial support to avoid the need for public funds
Dependency Criteria
To qualify as a carer, you must show proof that you are dependent on your relative in Australia for basic needs such as food, shelter and clothing, or that you will receive this support at least three years before submitting your application for disability.
Age Requirement
You need to meet the age requirement for receiving an aged pension as specified in the Social Security Act 1991.
Including Family Members in Your Visa Application
You may add your child or stepchild to your visa application.
Health and Character Requirements
Applicants and all their family members included in the visa application must:
- Undergo a medical examination within 12 months of applying for a visa to fulfill health requirements
- Obtain police identification cards from any state in which they have lived for 12 months or more in the last 10 years
Australian Values Statement
You and your dependent family members must sign the Australian Values Charter, pledging to respect the Australian way of life and follow its rules.
Outstanding Debts
You do not need to owe anything to the Australian Government for your visa to be approved.
