Remaining Relative Visa (Subclass 115)
The remaining visas are for relatives 115 the remaining visas are permanent residence visas for individuals who are the last remaining members of their family in their home country, when all their next of kin have migrated to Australia.
Visa applicants must be outside Australia (offshore) both at the time of visa application and at the time of visa issuance.
Advantages of Holding the 115 Visa
As a Remaining Relative visa holder, you have the right to:
- live in Australia permanently
- Apply for Australian citizenship, if you meet the requirements
- Leave Australia and return from Australia repeatedly for five years after your visa (after five years, you will need another visa to return to Australia).
Qualification Requirements
To qualify for this visa, you must:
- Next of kin residing in Australia are Australian citizens, Australian permanent residents, and/or eligible New Zealand citizens
- A suitable next of kin or their partner (who must be at least 18 years of age) who is willing to support you and all your family members.
- Give someone willing to guarantee support (a reasonable promise to donate money).
- Make sure you and your family caregivers meet health and behavioral requirements
Ineligibility Criteria for This Visa:
- You or your spouse’s immediate family are in illegal status, holding a bridging visa, or other temporary visa.
- Your sponsor, or their spouse, has previously held or sponsored someone on a balance-related visa (subclass 835 or 115), a preferred family visa (subclass 104), or a family visa (subclass 806).
Eligible Near Relatives Definition
The next of kin in Australia can be any of the following.
- Your parents or spouse’s parents, and birth parents
- Your brother or your spouse’s brother
- Your brother-in-law or sister-in-law
- Your child or stepchild who is 18 years of age or older and is not financially dependent on you
- Your child or stepchild under the age of 18 who is not living in your or your spouse’s care
Health & Character Requirements
Applicants and their dependent family members included in the visa application should:
- Get a health check and meet the basic medical standards required
- Obtain a police certificate of witness from any state in which you have lived with adult family members for more than one year in the last ten years (applies only to those aged 18 and over).
Outstanding Debts to the Australian Government
All existing fees must be paid to the Australian Government before your visa is approved.
